Procedure for obtaining authorization under
Hazardous and other Wastes (Management and Transboundary Movement) Rules, 2016.


First Authorization


1.  Every occupier of the facility who is engaged in handling, generation, collection, storage, packaging, transportation, use, treatment, processing, recycling, recovery, pre-processing, co-processing, utilization, offering for sale, transfer or disposal of the hazardous wastes and other wastes shall be required to make an application in Form 1 on the online portal of Haryana State Pollution Control Board i.e. http://hrocmms.nic.in/OCMMS/industryRegMaster/create1 or on the portal of HEPC i.e. http://investharyana.in

2.  No processing fee is required to be deposited for obtaining the authorization.

3.  Checklist of documents required for obtaining First/New authorization, is given at Annexure-A

4.  The validity of authorization will be 5 years.

5.  The units can operate their projects only after obtaining prior authorization.

6.  The application for authorization (except for recycling and utilization of Hazardous/other Wastes) for the projects/industries having investment more than Rs. 10 crore and involving CLU cases of more than 1 acre land, can be submitted on the portal of HEPC as well as on the portal of HSPCB, at present.

7.  The application received on HEPC portal are marked to the Nodal Officer deputed by the Board with HEPC for processing and deciding the same as per procedure laid down by the Board which are forwarded through online system to the concerned Regional Officer for scrutiny and verification. The applications applied on the portal of the Board, are directly received in the portal of Regional Officer concerned.

8.  Regional Officer mark the application further to the concerned field officer for scrutiny, verification and recommendation.

9.  Inspection of the industry is carried out by the authorized officer/ officers of the Board before commissioning of the production in the unit and before giving the 1st authorization, after getting approval from the Competent Authority, to check the status regarding installation of arrangements made by the unit at site for handling and management of Hazardous and Other Wastes, before deciding the cases of 1st authorization.

10.  After scrutiny of the application and site inspection of the industry, case is recommended for grant of authorization by the field officer to the Regional Officer in case application is found complete and the unit found installed the required arrangements at site for handling and management of Hazardous and Other Wastes.

11.  Thereafter, the Regional Officer forward the case to the Nodal Officer of the Board with HEPC with his recommendation for grant of authorization in case of the projects having investment more than Rs. 10 crore then the authorization is issued by the Nodal Officer through online system to the unit.

     In case of the projects having investment upto Rs. 10 crore then the authorization is issued at the level of Regional Officer itself through online system to the unit under his digital signature

12.  However, after verification if the application is found incomplete and discrepancies are observed in the installation of pollution control devices at site, show cause notice for refusal of authorization is issued for 15 days after approval from Regional officer.

13.  If the unit submits the satisfactory compliance report for the shortcomings conveyed through show cause notice, then the field officer recommend the case for grant of authorization to the Regional Officer who further submit his recommendation to the Nodal officer of Board with HEPC for grant of the same in case of the projects having investment more than Rs. 10 crore then and then authorization is granted at the level of Nodal Officer.

     In case of the projects having investment upto Rs. 10 crore then the authorization is issued at the level of Regional Officer itself through online system to the unit under his digital signature

14.  If the reply of show cause notice submitted by the unit is not found satisfactory or the unit fails to submit the reply of show cause notice, then the case is recommended by field officer to Regional Officer for refusal of the same who further submit his recommendation to the Nodal officer of Board with HEPC for refusal of the same, in case of the projects having investment more than Rs. 10 crore and then authorization is refused at the level of Nodal Officer in such cases.

     In case of the projects having investment upto 10 crore, the authorization is refused at the level of Regional Officer itself.

15.  In case of the units involved in recycling/utilization of Hazardous wastes/other wastes, the application is submitted to the concerned Regional Officer on hard copy separately for grant of specific authorization and passbook, to procure the raw material, for recycling/utilization of Hazardous wastes/other wastes.

     In such cases inspection is carried out by two officers of the Board i.e. Regional Officer and Concerned field officer and are forwarded to Head Office within 15 days and are decided presently at the level of Chairman.

     Timelines and process for processing such type of applications remain same as prescribed for other category of units not involved in recycling/utilization of Hazardous/ other Wastes

16.  Instructions already issued for clearances of authorization applications, within 60 days in normal circumstances and in 85 days in case of incomplete applications, vide order dated 20.10.2015.
